Airspace Security
This dimension of the frontier is the one directly overhead. Air is the fastest medium of attack and the hardest to fence, and secured airspace is a necessary layer of defence alongside the land and the sea. The threat ranges from a hostile aircraft to a hijacked airliner to, increasingly, a swarm of tiny drones — and the response spans international law, air defence, and the security of civil aviation.
Sovereignty Over Airspace — the Chicago Convention and Where Airspace Ends
The legal foundation is simple and absolute. The Paris Convention of 1919, and more definitively the Chicago Convention of 1944 — which created the International Civil Aviation Organization (ICAO), now with 193 member states including India — establish that every state has complete and exclusive sovereignty over the airspace above its territory, including the airspace over its territorial waters.
Unlike ships at sea, aircraft enjoy no automatic right of innocent passage; a foreign aircraft may enter national airspace only by permission.
But this raises the deeper question: where does airspace end? Sovereignty extends upward only through the airspace; above it lies outer space, which the Outer Space Treaty of 1967 declares free for the use of all and subject to no national appropriation.
Crucially, international law fixes no precise boundary between the two — the commonly cited Kármán line at about 100 km is a scientific convention, not a legal border. The implication is profound: a nation is sovereign over the aircraft in its skies but has no ownership of the space above, where foreign satellites pass freely overhead — a gap the law has never closed.
Air Defence, ADIZ and the IACCS Network
To manage this sovereign volume India divides its skies into functional zones — controlled and uncontrolled airspace for civil traffic, and prohibited, restricted and danger areas kept clear for security or safety, with a Flexible Use of Airspace concept to open unused military zones to commercial flights when idle.
For defence, India maintains Air Defence Identification Zones, within which every aircraft must identify itself and obtain clearance; an unidentified aircraft that strays without clearance is liable to interception by fighter aircraft.
The nerve centre of this effort is the Integrated Air Command and Control System (IACCS) — the Indian Air Force’s automated, networked backbone that fuses inputs from ground radars, airborne early-warning aircraft and other sensors into a single air-situation picture, enabling commanders to identify and engage threats across the country in near real time. Riding on a secure digital network, it converts a patchwork of radars into one seeing, layered air-defence shield.
Drone Rules 2021, Airspace Maps and Civil-Drone Regulation
The explosion of small drones has forced airspace security to reach down to a few hundred feet. The counter-drone side of this challenge — detection, jamming and neutralisation of hostile unmanned craft at the borders — was examined among the cross-border threats; here the focus is the regulation of legitimate civilian drones, the other half of the same problem.
The Drone Rules, 2021 replaced an earlier, restrictive regime with a liberalised, digital-first framework. Operations are managed through the Digital Sky online platform on a ‘no-permission, no-take-off’ basis, and the country is divided by an interactive airspace map into green, yellow and red zones — green for free flight up to specified heights, yellow requiring air-traffic clearance, and red where flight is barred. The design tries to hold two goals in balance: nurturing a fast-growing drone economy while ensuring that every lawful drone is known to the system, so that the unlawful one stands out.
Aviation Security — BCAS, CISF and Hijack Policy
The final layer protects civil aviation itself — the aircraft, airports and passengers that are both targets and, in the wrong hands, weapons, as the world learned on 11 September 2001. India’s civil-aviation security rests on a clear division of labour.
- The Bureau of Civil Aviation Security (BCAS) is the regulator — it lays down security standards for airports, airlines and cargo, and audits their compliance. It was raised in the wake of the 1985 Kanishka bombing, the deadliest reminder of aviation’s vulnerability.
- The Central Industrial Security Force (CISF) provides the physical security of the country’s civil airports, screening passengers and guarding the perimeter.
- Hijack response is governed by the Anti-Hijacking Act, 2016, which prescribes severe punishment — up to the death penalty where a hostage or security officer is killed — in line with international conventions, backed by a standing anti-hijacking policy under which, in the last resort, a decision on forcible intervention or even shooting down a hijacked aircraft rests with the highest political authority.
From the 1995 Purulia arms-drop that first exposed India’s vulnerability from the air, to the drone that now hums over a border field, the airspace has become a contested frontier in its own right — and securing it, like the land and the sea, demands that law, technology and vigilance advance together.
